1. Who We Are

The website [Sovereignty Trading Post] (the “Site”) is operated by [Sovereignty Trading Post] (“we,” “us,” or “our”). By visiting the Site or purchasing our products, you agree to be bound by these Terms of Use (the “Terms”), our Privacy Policy, and any other policies posted on the Site.

2. Eligibility & Minimum Age

• Tobacco and non-THC vaping products: Sales are restricted to individuals 19 years of age or older (or the higher legal age where you live).

• Medical THC products (including THC vapes): Sales are restricted to eligible patients and are subject to the legal requirements that apply to you (see Section 3).

• You represent that you meet the applicable minimum age and eligibility requirements, that your information is accurate, and that you are not purchasing for a minor or any other ineligible person.

3. Legal Compliance (Tobacco, Vaping, Medical THC)

You acknowledge that our activities and your use of the Site are subject to applicable laws and regulations, including federal and provincial/territorial rules on tobacco, vaping, and cannabis.

• Within Québec (medical THC): Purchases must comply with the Cannabis Regulation Act (Québec) and all related rules.

• Outside Québec (medical THC): Purchases must comply with the laws and regulations of your province/territory or state.
  If there is any conflict, the applicable law prevails. We may refuse, limit, or cancel any order to ensure compliance.

4. Geographic Restrictions & Delivery

• We ship only where permitted by law. Some locations may be excluded.

• Kahnawà:ke restriction: No vaping products will be sold or delivered on the Mohawk Territory of Kahnawà:ke. Orders to that territory containing vaping products will be declined or cancelled.

• Age/ID verification may be required at purchase and/or delivery. Carriers may refuse delivery if age or identity cannot be verified.

• No shipment to addresses that are prohibited (e.g., certain collective addresses or P.O. boxes) where not allowed.

5. Medical THC: Account & Verification

To purchase medical THC products, you may be required to:

1. create an account and complete our identity checks;

2. provide valid documents as required by applicable law;

3. keep your information current.
   We may verify documents, request additional information, refuse or close an account, or decline an order at any time.

6. Health Information & Important Notices

Site content is informational only and does not constitute medical advice, diagnosis, or treatment. Consult a qualified health professional before use. No therapeutic benefit is guaranteed. Tobacco and vaping products present health risks and can be addictive. Do not drive or operate machinery after consuming THC. Keep all products out of reach of children and pets.

7. Orders, Accounts & Accuracy

We may refuse, limit, or cancel any order (by customer, address, card, region, or product). Provide accurate, complete information (email, address, payment) and update your account as needed. Prices, stock, descriptions, and images may change without notice.

8. Pricing, Taxes & Payment

Prices are shown in [CAD], before applicable taxes, shipping, and regulatory fees. Payments are processed by third-party providers. Abusive chargebacks may lead to account closure.

9. Returns & Defects

For safety and hygiene reasons, all sales are final once packaging is opened, except for confirmed defects or where required by law. For defective products, contact us within [X] days with proof (order number, photos). Remedies (replacement/refund) are at our discretion and subject to law.

10. Prohibited Uses

You must not: (a) violate laws/regulations; (b) purchase for a minor; (c) misrepresent patient eligibility; (d) circumvent age/identity controls; (e) resell or divert products; (f) introduce malware or disrupt the Site; (g) scrape or harvest personal data without right; (h) make unauthorized health claims; (i) use the Site in an abusive, misleading, or unlawful manner. We may suspend or terminate access for violations.

11. Intellectual Property & Limited Licence

The Site and its content (text, designs, trademarks, images) are protected. We grant you a limited, non-exclusive, revocable licence to access the Site for lawful personal use. Any unauthorized reproduction or exploitation is prohibited.

12. Third-Party Tools & Links

We may provide access to third-party tools or links “as is.” We do not warrant or assume responsibility for third-party content, policies, or practices. Review their terms before use.

13. Accuracy & Updates

We aim for accuracy, but the Site may contain errors or omissions. Information is provided for guidance only and may be updated without notice. Use content at your own risk.

14. Disclaimers & Limitation of Liability

The Site and products are provided “as is” and “as available.” To the extent permitted by law, we disclaim all warranties, express or implied (including merchantability, fitness for a particular purpose, accuracy, and availability).

These Terms are governed by the laws of the Province of Québec and the applicable laws of Canada. Any dispute will be submitted to the courts of the judicial district of Montréal (Québec).

A. Health Warnings 
Tobacco and vaping products contain substances that may cause addiction and serious health risks. THC may cause adverse effects (drowsiness, cognitive impairment, drug interactions). Do not drive or use machinery after consuming THC. Keep away from children and pets.

B. Advertising & Claims
No therapeutic or health claims are made or should be inferred unless expressly permitted by law. Images, descriptions, and reviews are illustrative and non-contractual.

C. Legal Limits on Content/Strength
Certain concentrations (e.g., nicotine/THC), formats, flavours, or devices may be restricted or prohibited. Offers are void where prohibited.

D. Resale & Diversion
Resale, sharing, or diversion of products—especially those containing THC—is strictly prohibited. Suspected cases may be reported to authorities.
